Welcome to Wadata! These Terms of Service ("Terms") govern your use of the Wadata platform—Africa's ethical data and AI marketplace. By creating an account or using our services, you agree to these Terms. Please read them carefully.
By accessing or using Wadata, you agree to be bound by these Terms, our Privacy Notice, and our Cookie Policy.
Wadata is a marketplace platform connecting:
Youth and women trained in ethical data work who complete jobs, earn income, and build digital skills.
Organizations, NGOs, AI companies, and enterprises that post jobs and access quality, ethical data.
NGOs, trainers, and local hubs that sponsor training programs and support Data Champ development.
Funders who invest in skilling programs, job creation, and track measurable social impact.
Wadata acts as an intermediary—we facilitate connections, payments, and training but do not employ Data Champs. Users are independent contractors responsible for their own work and taxes.
You must provide accurate, complete, and current information when registering. You are responsible for safeguarding your password and account credentials.
Each person may have only one account. Creating multiple accounts to manipulate ratings, payments, or platform features is strictly prohibited.
To withdraw funds, you must complete Know Your Customer (KYC) verification by submitting a government-issued ID and proof of address.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, harassment, or unethical behavior.
To maintain a safe, ethical, and respectful community, you agree NOT to:
Submit fake data, manipulate ratings, or misrepresent qualifications
Harass, threaten, bully, or discriminate against other users
Use Wadata for money laundering, terrorist financing, or any illegal purpose
Send spam, viruses, or attempt to hack or disrupt the platform
Scrape, collect, or misuse data from other users without consent
Circumvent platform security, payment systems, or access controls
⚠ Violation Consequences:
Users who violate these rules may face account suspension, termination, forfeiture of earnings, and legal action where applicable.
Before posting a job, Clients deposit payment into a secure Escrow account managed by Wadata.
Data Champs accept the job, complete the work, and submit it for review.
Once the Client confirms the work meets quality standards, the payment is released from escrow.
Payment is automatically transferred to the Data Champ's Wadata Wallet following the 75/20/5 Revenue Share Model:
Data Champs can withdraw earnings anytime via M-Pesa, bank transfer, or crypto (subject to KYC verification).
Taxes: Data Champs are independent contractors responsible for reporting earnings and paying applicable taxes in their jurisdiction. Wadata does not withhold taxes.
Tectona Group Limited owns all rights to the Wadata platform, software, branding, logos, and proprietary algorithms. Users may not copy, modify, or reverse-engineer Wadata's technology without permission.
Data Champs: You retain ownership of data you create or submit. By uploading data to Wadata, you grant us a non-exclusive, royalty-free license to use, process, and distribute it as part of fulfilling Client jobs.
Clients: Upon payment and job completion, Clients receive a license to use the data as specified in the job agreement, along with a Conscious Compliance Passport documenting consent and ethical sourcing.
Community Data: Any community-generated data is governed by Free Prior and Informed Consent (FPIC) principles and community agreements.
Wadata is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or that the platform will meet all your needs.
Wadata does not employ Data Champs. All users are independent contractors. We are not liable for employment benefits, taxes, insurance, or disputes between users.
To the fullest extent permitted by law, Wadata is not liable for indirect, incidental, consequential, or punitive damages arising from platform use, data loss, payment issues, or user disputes. Our total liability is limited to the amount of fees paid to Wadata in the past 12 months.
Wadata is not responsible for delays or failures caused by events beyond our control (e.g., natural disasters, government actions, internet outages, pandemics).
You may close your account anytime from your settings. Upon closure, you must withdraw any remaining wallet balance within 30 days, after which unclaimed funds may be forfeited.
We may suspend or terminate your account for violating these Terms, fraudulent activity, or to comply with legal obligations. We will provide notice where legally required, except in cases of immediate security threats.
These Terms are governed by the laws of Kenya and international data protection regulations (GDPR where applicable).
You agree to resolve disputes individually, not as part of a class action lawsuit, unless prohibited by local law.
We may update these Terms to reflect platform changes, legal requirements, or new features. When we do:
If you disagree with updated Terms, your remedy is to stop using Wadata and close your account.
